Terms of Service

Last updated: [date]

This page is a starting draft, not legal advice. Replace the bracketed placeholders (legal entity, address, governing law, contact) and have qualified counsel review this — especially the health/liability sections — before relying on it.

These Terms of Service (“Terms”) govern your access to and use of Liftscribe (the “Service”), operated by HMO Europe B.V. (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

Liftscribe is a training and nutrition coaching platform. It supports two ways of using it: as a client of an independent coach who manages your programming, or as a self-coached athlete using our AI-assisted tools directly. Coaches on the Service are independent professionals, not our employees or agents —Liftscribe provides the software; the coaching relationship and its advice are between you and your coach.

2. Eligibility and your account

  • You must be at least 16 years old (or the minimum age of digital consent where you live) to use the Service.
  • You're responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
  • You're responsible for activity that happens under your account.
  • Notify us promptly if you believe your account has been compromised.

3. Health and medical disclaimer

Liftscribe, including any AI-generated training plan, nutrition guidance, or coach message, is not medical advice and is not a substitute for consultation with a qualified physician or other healthcare provider.

  • Consult your doctor before starting any exercise or nutrition program, especially if you have any existing health condition, injury, or are pregnant or postpartum.
  • Physical exercise carries inherent risk of injury. You use any training plan or exercise instruction at your own risk.
  • AI-generated content is produced from the information you provide and general fitness principles; it can be wrong, generic, or unsuitable for your specific situation. Review it critically and stop any movement that causes pain.
  • If you experience chest pain, dizziness, or any emergency symptom, stop immediately and seek emergency medical care — do not rely on the Service.

4. Premium subscriptions and billing

Liftscribe is free to use. Premium is an optional subscription that adds, among other things, auto-progression, AI-built plans, the AI coach, the weekly AI review, adaptive calorie targets, meal plans and analytics over any time range. Logging your workouts and food, your full history and barcode scanning stay free.

  • Where you buy it. Premium is sold as an in-app purchase in the Liftscribe iPhone app and billed by Apple through your Apple ID. There is no checkout on our website; a subscription bought on the iPhone also applies to the same account on the web and on Android. Apple, not us, is the seller of the in-app purchase and Apple's terms apply to the payment.
  • Plans and prices. Annual €39.99 a year (a limited launch offer of €29.99 for the first year applies where the App Store shows it) and monthly €12.99 a month. The price, currency and any local taxes shown in the App Store at purchase are the ones that apply; they can differ by country.
  • Free trial. New subscribers to the annual plan get a 7-day free trial if the App Store offers it to them (Apple decides eligibility, once per Apple ID). Unless you cancel at least 24 hours before the trial ends, it converts into a paid annual subscription at the price shown, charged to your Apple ID.
  • Automatic renewal. Subscriptions renew automatically for the same period at the then current price until you cancel. Payment is charged to your Apple ID at confirmation of purchase and, on renewal, within 24 hours before the end of the current period. You can turn off auto-renewal at any time, but at least 24 hours before the period ends.
  • Cancelling. Manage or cancel in your device's Settings → your name → Subscriptions, or from Account → Premium → Manage subscription in the app. You keep Premium until the end of the period you paid for. Deleting your Liftscribe account does not cancel an Apple subscription; cancel it with Apple first.
  • Refunds. Apple processes payments and refund requests for in-app purchases (via reportaproblem.apple.com); we cannot refund them ourselves. Your statutory consumer rights are not affected. [Counsel to confirm wording on the statutory right of withdrawal for digital content.]
  • Price changes. If a price for an existing subscription changes, Apple notifies you and, where the law requires, asks for your consent. If you do not agree, the subscription ends at the end of the paid period.
  • Restoring and changing devices. Use “Restore purchases” in the app on a new device or after reinstalling.
  • Coached clients. If you are linked to a coach who uses Liftscribe, Premium is included through your coach for as long as you are linked, and you do not need to subscribe. Coaches use Liftscribe free during the launch period; separate coach plans will be announced in advance and are not charged automatically.

5. AI points and fair use

Features that call an AI model (such as logging a meal from a photo, voice or label, the AI coach chat, plan generation and plan edits by chat) use AI points. Logging by search or barcode, browsing, and your history never cost points.

  • Monthly allowance. Currently 30 points a month on the free plan, 250 on Premium annual and 500 on Premium monthly. The allowance resets at the start of each calendar month and does not roll over. How many points an action costs is shown next to it in the app.
  • Point packs. You can buy a pack of 200 points in the app (currently €1.99, a one-time purchase, not a subscription). Packs are used after the month's allowance is gone and do not expire. If the account is closed, unused points have no cash value.
  • Fair use. To keep the Service sustainable there is a daily limit on points per account and a short-term limit on requests per minute. We may change allowances, point costs and limits as model costs change, and will not reduce what you already paid for during the paid period. Using the Service to resell AI output, to automate bulk requests or to circumvent the limits is not allowed.
  • Coached clients use their coach's monthly AI budget instead of their own allowance. If that budget is used up, AI actions pause until it refills; logging keeps working.

6. AI-generated content

Training plans, nutrition targets, weekly reviews, and draft coach replies may be generated in whole or part by AI systems. We design this to be useful and evidence-informed, but we don't guarantee AI output is accurate, complete, or appropriate for your circumstances. You (and, where applicable, your coach) are responsible for reviewing AI-generated content before relying on it.

7. Acceptable use

You agree not to:

  • Use the Service for anything unlawful, or to harass, abuse, or harm another person.
  • Attempt to access another user's account or data without authorization.
  • Interfere with or disrupt the Service's operation or security.
  • Scrape, reverse-engineer, or resell the Service without our written permission.

8. Your content

You retain ownership of the content you upload (progress photos, logs, messages). You grant us a license to store, process, and display that content solely to provide the Service to you and, where applicable, your coach. Coach-authored content (programs, meal plans, messages) belongs to the coach, subject to the same license for us to operate the Service.

9. Termination and account deletion

You may stop using the Service, or permanently delete your account and data, at any time (self-coached accounts can do this directly from Account → Delete account; see our Privacy Policy for exactly what that removes). We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the maximum extent permitted by law, HMO Europe B.V. is not liable for any indirect, incidental, special, or consequential damages, or for any injury, loss, or damage arising from your use of the Service, including reliance on AI-generated training or nutrition content. [This section needs jurisdiction-specific legal review — some jurisdictions don't allow certain liability limitations.]

12. Governing law

These Terms are governed by the laws of [jurisdiction], without regard to conflict-of-law principles. [Add dispute resolution / venue clause with counsel.]

13. Changes to these Terms

We may update these Terms as the Service changes. We'll update the “Last updated” date above; for material changes we'll make reasonable efforts to notify active users directly.
